TERMS OF SERVICE
1. Agreement to Terms
By visiting theleveluplegion.com, booking a Strategy Call, or enrolling in the Foundation Protocol, you agree to these Terms of Service. Read them before you proceed. If you do not agree, do not use our site or services.
These terms are a binding agreement between you and Patrick Tromley, doing business as The Level Up Legion.
2. Program Description
The Foundation Protocol is a 90-day private coaching program designed for executive dads who are serious about reclaiming their physical performance, mental sharpness, and daily discipline. The program includes:
The Foundation Protocol structure across three pillars
90 days of direct access to Patrick Tromley
The Daily Battle Plan framework
Full access to the War Room app where the program is housed
Program content, structure, and delivery methods may be adjusted at Patrick's discretion to better serve the client's progress.
3. Eligibility
You must be at least 18 years of age to enroll. By purchasing, you confirm that you are legally capable of entering into a binding agreement and that you are not prohibited from doing so under any applicable law.
4. Payment Terms
The current investment for the Foundation Protocol is $5,000 USD.
Payment is due in full at the time of enrollment unless a written payment arrangement has been agreed upon separately
All payments are processed securely through our payment provider
By submitting payment, you authorize the charge to your selected payment method
All prices are listed in USD
If a payment plan is agreed upon and a scheduled payment fails, access to the program and coaching may be paused until the balance is resolved.
5. Refund Policy and Performance Guarantee
We stand behind the Foundation Protocol and the results it produces when the work is done.
The Guarantee: If you complete 90 days of the Foundation Protocol, follow the program as prescribed, and do not lose at least 20 pounds, Patrick Tromley will continue coaching you at no additional cost until you hit that result.
To qualify for the guarantee, you must:
Complete all 90 days of the program
Follow the prescribed nutrition, training, and daily structure protocols
Attend scheduled check-ins and maintain open communication
Document your progress as directed throughout the program
Refund Policy: Outside of the performance guarantee above, all sales are final. We do not offer refunds once the program has been accessed or coaching has begun. This policy exists because we deliver real time, real expertise, and real resources from day one.
If you have a concern about your enrollment, contact us before your start date and we will work with you in good faith.
6. Health and Medical Disclaimer
The Foundation Protocol involves physical training, nutritional guidance, fasting protocols, and lifestyle change. By enrolling, you acknowledge that:
You are voluntarily participating in a fitness program
You have consulted or will consult with a qualified healthcare provider before beginning if you have any pre-existing medical conditions
The Level Up Legion and Patrick Tromley are not licensed medical professionals and nothing in this program constitutes medical advice, diagnosis, or treatment
Results will vary based on individual commitment, physiology, and consistency
You assume full responsibility for your health and safety during the program
If you experience adverse health effects at any point, stop and seek medical attention immediately.
7. Intellectual Property
All content created and delivered by The Level Up Legion — including but not limited to the Foundation Protocol curriculum, the Daily Battle Plan framework, War Room app content, videos, written materials, and coaching methods — is the intellectual property of Patrick Tromley.
You may not copy, reproduce, distribute, teach, or sell any part of this material without written permission. This applies during and after your time in the program.
Violation of this section may result in immediate removal from the program without refund and legal action.
8. Confidentiality
Patrick agrees to keep your personal information, health data, and coaching conversations confidential, except where disclosure is required by law.
You agree to keep any proprietary frameworks, systems, and materials shared within the program confidential. These are not to be shared publicly or with competitors.
9. Client Responsibilities
Getting results requires your full participation. By enrolling, you commit to:
Showing up to your Strategy Call and check-in sessions
Following the program structure with honesty and consistency
Communicating openly when something is not working
Taking ownership of your outcomes
The Level Up Legion provides the system. The results depend on you executing it.
10. Program Termination
Patrick Tromley reserves the right to terminate a client's enrollment at his sole discretion if the client:
Is abusive, threatening, or disrespectful toward Patrick or any staff
Violates intellectual property or confidentiality terms
Provides false information during onboarding
Engages in behavior that undermines the integrity of the program
In the event of termination for cause, no refund will be issued.
If Patrick terminates enrollment for reasons unrelated to client conduct, a pro-rated refund will be offered based on days remaining in the 90-day program.
11. Limitation of Liability
To the fullest extent permitted by law, The Level Up Legion and Patrick Tromley are not liable for:
Indirect, incidental, or consequential damages arising from your participation in the program
Injury or health complications resulting from physical training or dietary changes
Loss of income, business, or opportunity connected to your enrollment
Our total liability in any dispute is capped at the amount you paid for the program.
12. Governing Law and Dispute Resolution
These Terms of Service are governed by the laws of the State of Utah, without regard to conflict of law principles.
Any dispute arising from these terms or your participation in the Foundation Protocol will first be addressed through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be submitted to binding arbitration in Utah under the rules of the American Arbitration Association.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Entire Agreement
These Terms of Service, combined with the Privacy Policy above, represent the entire agreement between you and The Level Up Legion. They supersede any prior conversations, representations, or agreements made verbally or in writing.
